JUSTICE ARUN KUMAR ORAL ORDER 11-07-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 20.4.2018, seeks bail in Kasma PS Case No. 58 of 2017 registered under Sections 302 and 201 of the IPC.

The allegation in brief is that a dead body was found, case was instituted against unknown by the local Chaukidar and it is suspected that the deceased was killed by the family members of Bindu with whom he was in love affairs.

Learned Counsel for the petitioner submits that except suspicion raised by the deceased's father that due to love affairs of his son with daughter of Rajdeo Thakur, he has been eliminated by them but no such evidence has been collected during investigation, the petitioners are wife and son of Rajdeo Thakur, co-accused Pramod Thakur has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 62536 of 2018 and the petitioners have no criminal antecedent.

Having considered the said facts and circumstances, the petitioners, namely, Kalawati Devi and Birendra Thakur are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Kasma PS Case No. 58 of 2017.
