The petitioner is languishing in custody since 12.02.2019 in a case registered for the offences punishable under Sections 395 and 397/34 of the IPC.
The prosecution case is that on 17.12.2018 at about 12.30 A.M., 5 to 7 unknown persons entered into the house of the informant and robbed cash amount to the tune of Rs. 2 lacs, jewellery and a mobile phone, leading to registration of FIR against unknown persons. The name of the petitioner sprang up during investigation on the confession of co-accused person. It is submitted by learned counsel for the petitioner that admittedly no recovery has been made from the possession of the petitioner and the petitioner has not been put on T.I. Parade.

Learned APP submits that the name of the petitioner sprang up during investigation on the confession of co-accused person. Considering the fact that no recovery has been made from the possession of the petitioner and the petitioner has not been put on T.I. Parade, though investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned J.M., 1st Class, Jamui in connection with Laxmipur P.S. Case No. 302 of 2017.
