The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 195 of 2019 for the offence under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from field of sugar cane which does not belong to the petitioner and the petitioner has no

Patna High Court CR. MISC. No.63436 of 2019(2) dt.22-10-2019 2/2 concern with the alleged recovery. The petitioner is rotting in judicial custody since 26.07.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge -cum- Special Judge, Excise, East Champaran, Motihari in connection with Kalyanpur P.S. Case No.195 of 2019.
