JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2022 In this writ petition, the petitioner is seeking direction to the respondents District Magistrate, Saharasa and the Circle Officer, Nauhatta, District- Saharsa not to displace him from the land situated in "Kedi Dharampur Trikuti Purnarvas Asthal" by adopting pick and choose policy as the said land had been settled to his grand-father in the year 1984. I have heard learned counsel for the parties at length and perused the materials available on record particularly in the counter affidavits.
In the opinion of this Court, this writ petition is misconceived as the petitioner has not been able to establish any
Patna High Court CWJC No.67 of 2018(3) dt.05-07-2022 2/2 legal right over the land in question. Further, there is no document which suggests that the petitioner has legal right over the land in question. Hence, this Court cannot issue mandamus in favour of the petitioner.
In such view of the matter, this writ petition is devoid of any merit and it is accordingly, dismissed. (Sandeep Kumar, J) pawan/- U
