2. The petitioner apprehends his arrest in connection with Patliputra P.S. Case No. 325 of 2025 registered for the offences under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the prosecution story, an FIR was lodged based on a report by Upnandan Yadav (ASI, Patliputra Police Station, Patna). On 16.08.2025, while patrolling near Baba Chowk, the police received secret information that two individuals - Sony Rai and Vikram Vishwakarma - were selling country-made liquor, one from his gumti (stall) and the other from his bathroom at Mainpura Gate No. 53. When the
Patna High Court CR. MISC. No.69063 of 2025(2) dt.08-10-2025 2/3 police reached the location around 7:15 p.m., both suspects fled through narrow lanes taking advantage of the darkness. The police recovered 13 bottles (250 ml each) of country-made liquor from Sony's stall and 10 litres from a container in the bathroom, totaling 13 litres. The recovered liquor was deposited in the police station malkhana.
4. Learned counsel for the petitioner submits that the seized articles was recovered from one Gumti of Sony Rai as well as from Mainpura Gate No.53, which is said to be an open place and access to general public cannot be over-ruled. The petitioner has clean antecedent.
5. Learned APP for the State opposes the prayer for anticipatory bail application.

Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the conscious possession and / or premises belonging to the petitioner and the petitioner has clean antecedent, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on

No.69063 of 2025(2) dt.08-10-2025 3/3 furnishing bail bond of Rs. 5000/- (rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court, Patna, in connection with Patliputra P.S. Case No. 325 of 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023.
