JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 307, 436, 379 and other allied sections of the IPC. Petitioner is not named in the first information report which has been lodged against more than 124 named accused persons when a communal riot took place between two communities. The name of the petitioner surfaced in this case in course of investigation. However, having more or less similar allegation several co-accused have already been granted privilege of bail by coordinate benches of this court vide order dated 21.6.2018 passed in Cr. Misc. no.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Aurangabad (Town) P.S. Case no. 100/2018.
