JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bihiya P.S.Case No. 231 of 2017 registered under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian penal Code. Allegation in brief is that this petitioner is said to have given knife blow twice over the head of the informant's wife and when he went to rescue his wife then other accused persons also assaulted him with lathi and danda causing injury. Learned counsel for the petitioner submits that on trivial issue for using lavatory, the alleged occurrence is said to have taken place and allegation against petitioner is that he had given knife blow twice over the head but no such corresponding injury of knife over the head is found, except bruise and cause of death, according to post-mortem is dehydration.

Patna High Court Cr.Misc. No.61323 of 2017 (3) dt.20-02-2018 2/2 Leaned counsel for the State opposed the prayer of bail but concedes that no piercing injury is found over the head of the deceased except a bruise.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Sandeep Paswan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mrs. Noor Sultana, ACJM, Bhojpur at Ara in connection with Bihiya P.S. Case No. 231 of 2017.
