The petitioner seeks bail in connection with Naubatpur P.S. Case No. 367 of 2019 (Special Case No. 5086 of 2019) for the offence under Section 30(a) and 38(ii) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from bushes and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 06.08.2019.

No.63593 of 2019(2) dt.22-10-2019 2/2 Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Naubatpur P.S. Case No. 367 of 2019.
