ANJANA MISHRA ORAL ORDER 17-07-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 30.05.2018 in connection with Nadi P.S. Case No.17 of 2018 registered for the offence under Sections 147, 148, 149, 341, 323, 307, 332, 333, 427, 353 and 504 of the Indian Penal Code. Learned counsel for the petitioners submits that in connection with the case of unlawful assembly with intention to commit bloodshed, the petitioners have been made named accused along with other 100 unknown accused persons. Learned counsel for the petitioners submits that out of 39
Patna High Court Cr.Misc. No.42455 of 2018 (2) dt.17-07-2018 2/2 named accused, several other co-accused have been granted bail by this Court. There is no overt act attributed against the present petitioners. It is further submitted that on the same date, for the same occurrence another case was also lodged in which the petitioners have also been named.
Considering the aforementioned facts and circumstances of the case and that other similarly situated coaccused persons, have already been granted bail by this Court vide order dated 05.07.2018 passed in Cr.Misc. No.37927 of 2018, vide order dated 09.07.2018 passed in Cr.Misc. No.35960 of 2018 and vide order dated 09.07.2018 passed in Cr.Misc. No.39640 of 2018, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateII, Bagaha, West Champaran, in connection with Nadi P.S. Case No.17 of 2018.
