JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Piprakothi P. S. Case No. 142 of 2019, disclosing offences under Sections 341, 323, 504, 506, 435, 379, 34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

In view of the submission of learned counsel for the petitioners that petitioner no.1 was arrested during the pendency of this application.

Accordingly, this application stands dismissed as withdrawn against petitioner no.1.

As per F.I.R. petitioner no.1 and other accused persons came to the house of the informant armed with pistol and Sword and one accused Ranjeet Kumar fired and it is also

Patna High Court CR. MISC. No.64832 of 2019(2) dt.17-10-2019 2/2 alleged that they set "Bhusaul" on fire.

Submission of the learned counsel for the petitioners is that F.I.R. itself shows that no allegation of firing has been attributed against the petitioner, rather allegations are general in nature. Petitioner no.2 has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner no.2, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Piprakothi P. S. Case No. 142 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
