A counter affidavit has been filed on behalf of respondent nos. 5 to 8 with categorical averments therein that the family pension of the petitioner was not being paid due to reason that her name has not been entered in the Pension Payment Order (PPO) of her late husband, Ram Narain Thakur. After verification and getting the necessary authenticated documents from the Treasury Officer, Motihari, the Centralized Pension Processing Centre of the Bank has started making payment of the current family pension to the petitioner with effect from February, 2023. It is further averred that payment of arrears of family pension for the period from 06.11.2018 to 31.01.2023 amounting to Rs.6,12,059/- is concerned, after making calculation of the same, the Centralized Pension Processing Centre of the respondent Bank vide its letter dated 21.03.2023 requested the Treasury Officer, Motihari for approval and sanction of the arrears payable to the petitioner.

It is submitted on behalf of the petitioner that though the letter for approval and sanction of the arrears of family pension has been sent to the Treasury Officer, Motihari way back on 21.03.2023, but till date the petitioner has not been paid her arrears, though the husband of the petitioner died on 05.11.2018 itself.

Considering the submissions advanced on behalf of the parties and the averments made in the counter affidavit, filed on behalf of respondent nos. 5 to 8, this Court dispose of the writ petition with a direction to the Treasury Officer, Motihari to ensure proper approval for payment of arrears of family pension preferably within a period of four weeks' from today, failing which the petitioner shall be at liberty to claim interest over the delayed payment, which shall be realized from the pocket of the responsible officer.
