The petitioner has prayed for regular bail in a case instituted for the offence under Sections 364(A), 365 and 34 of the Indian Penal Code.

As per prosecution case, the informant's son went to Gaya for marketing thereafter the informant received a ransom call of Rs. 2,50,000/- against kidnapping of his son otherwise your son be killed.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that petitioner has not named in the FIR. The victim boy has been recovered by the

Patna High Court CR. MISC. No.73944 of 2022(3) dt.07-04-2023 2/2 police. He submitted that the name of the petitioner has come into light during the course of investigation. He further submitted that the co-accused, who is named in the FIR has already granted bail by a Co-ordinate Bench vide order dated 05.05.2022 passed in Cr. Misc. No. 59627 of 2021. He is languishing in judicial custody since 08.06.2021. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Session Judge-1st, Gaya in connection with Fatehpur P.S. Case No. 185 of 2021.
