The petitioner seeks bail in connection with Excise Case No. 66C2 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submitted that the petitioner is not named in the F.I.R. The name of the petitioner has transpired during investigation. In the instant case total 3544.920 liters of foreign liquor was seized from the Bolero Pick Up Van. Learned counsel for the petitioner further submits that there is no recovery from conscious possession of the petitioner. Learned counsel for the petitioner further submits that another co-accused Ram Babu Kumar has been granted bail

Patna High Court CR. MISC. No.65360 of 2019(2) dt.05-11-2019 2/2 by a Co-ordinate Bench of this Court on 29.07.2019 vide Cr. Misc. No.46965 of 2019. Learned counsel for the petitioner further submits that the petitioner had earlier accused for the same offence in Balia P.S. Case No.188 of 2018 and another accused in Barauni P.S. Case No.574 of 2018 for the alleged offence under Sections 8, 20, 22 of the N.D.P.S. Act. He further submits that the petitioner has remanded this case on 23.08.2019.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II cum Special Judge (Excise Act), Begusarai in connection with Excise Case No. 66C2 of 2019.
