JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Gardanibag P.S. Case No.08 of 2018, registered for offences punishable under Section 379 the Indian Penal Code. As per F.I.R., allegation against the petitioner is of theft of mobile from the shop of the informant and it appears that mobile was recovered from one co-accused, Vicky Kumar and said Vicky Kumar has made this petitioner as a accused. Submission of the learned counsel for the petitioner is that only on the confession of the co-accused, Vicky Kumar, there is absolutely nothing against the petitioner and the petitioner has been falsely been implicated in this case and the petitioner has clean antecedent.

Patna High Court Cr.Misc. No.41915 of 2018 (2) dt.19-07-2018 2/2 Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Gardanibagh P.S. Case No.08 of 2018 to the satisfaction of learned Sub Judge -XIV cum A.C.J.M, Patna subject to the conditions as laid down laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
