ANJANA MISHRA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 26.05.2018 in connection with Jokihat P.S. Case No.145 of 2018 registered for the offence under Sections 147, 148, 149, 150, 323, 307, 353, 504, 379 and 511 of the Indian Penal Code.
Learned counsel for the petitioner submits that altogether false and mischievous allegation has been made against the petitioner that he along with other co-villagers obstructed the authorized Magistrate who had gone to seize some cash from the house of one Public Distribution System Dealer. The petitioner was named as one such persons and he has been put behind bars.
Patna High Court Cr.Misc. No.42622 of 2018 (2) dt.19-07-2018 2/2 The allegation against the petitioner is that he along with other co-villagers blocked the road and by using abusive language attacked the police by Lathi, Danda and snatched back the money seized by them.
Considering the peculiar nature of allegation and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Jokihat P.S.
