ANJANA MISHRA ORAL ORDER 18-01-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 25.08.2017 in connection with Cheriya Bariyarpur P.S. Case No.170 of 2013 registered for the offences under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted that the main accused person, who is alleged to have fired, namely, Ram Pravesh Paswan, has since been acquitted in this case and the petitioner has been named in connection with the present case as his associate, though there is no specific allegation against him.
Considering the fact that said Ram Pravesh Paswan has been acquitted, vide judgment dated 04.09.2015 (Annexure

2) and that none of the witnesses examined during the course of trial disclosed the complicity of the present petitioner, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri B.K. Ray, learned Judicial Magistrate 1st Class, Begusarai, in connection with Cheriya Bariyarpur P.S. Case No.170 of 2013.
