The petitioner is apprehending his arrest in connection with Sahebpur Kamal P.S. Case No. 329 of 2017, registered for the offences punishable under Sections 166, 167, 420, 467, 468 and 471of the Indian Penal Code.

Allegation is that the petitioner who happens to be Ujrat Bhogi Amin, was in the Bihar Settlement Office, Begusarai. There is allegation that there was gross negligence and irregularity committed by the petitioner in the survey proceeding. Submission of learned counsel for the petitioner is that work of the petitioner was to make entry as per the order passed by the Kanoongo and Settlement Officer after verification of the documents. Further submission is that whole allegation is false

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Begusarai, in connection with Sahebpur Kamal P.S. Case No.329 of 2017, subject to conditions as laid down under section 438 (2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that he has to co-operate in the investigation of the case and make himself available as and when required by the police, otherwise the prosecution is free to move for cancellation of his bail bond.

With the aforesaid observation, this application is allowed.
