JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This application, for grant of anticipatory bail, arises out of Bhagwanpur P.S. Case No. 218 of 2018, disclosing offences under Sections 341, 342, 323, 307, 354, 504, 506, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that on his order other accused persons assaulted the informant and later on petitioner also assaulted him by butt portion of rifle. Submission of learned counsel for the petitioner is that there is enmity between the parties from before and other accused persons having similar allegation has been granted the privilege of anticipatory bail vide order dated 13.05.2019 passed in Cr. Misc. No. 31248 of 2019.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Vaishali, Hajipur, in connection with Bhagwanpur P.S. Case No. 218 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
