2. The petitioner seeks bail in connection with Nawada (Town) P.S. Case No. 384 of 2021 registered for the offence under Section 33, 34 and 36 of the Excise Act, 2016.

3. As per the prosecution case, the police, on confidential information have recovered 15 liters of illicit liquor and it is further alleged that several persons, after consuming illicit liquor fell ill and one out of them has died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 14.03.2022.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-I, Nawada in connection with Nawada (Town) P.S. Case NO. 384 of 2021.

9. As a condition of this order, the petitioner, on being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on the dates fixed for hearing.

10. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Nawada Muffasil Police Station on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
