The petitioner is in custody since 08.08.2017 on his remand in connection with Kishanganj P.S. Case No. 265 of 2017 for the offence registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the first information report but on the basis of the confessional statement made before the police by coaccused, Nausad Alam, the petitioner has been taken into custody. It is further submitted that till date no T.I. Parade has been conducted.

Considering the aforesaid facts and circumstances of the case and that there is no recovery from the possession of the

No.42440 of 2018 (2) dt.17-07-2018 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Kishanganj in connection with Kishanganj P.S. Case No. 265 of 2017.
