The petitioner is languishing in custody in a case registered for the offences punishable under Sections 8(c), 21(b) of the N.D.P.S Act and Section 30(a) of the Bihar Prohibition & Excise Act.
There is recovery of 180 ml of litres of illicit Indian made Foreign liquor from the petitioner whereas from the possession of co-accused Sahil @ Ganesh @ Rockey, 60 grams of brown sugar was recovered. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely
Patna High Court CR. MISC. No.69182 of 2022(2) dt.25-02-2023 2/2 been implicated in this case. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with coaccused Sahil @ Ganesh @ Rockey or the recovered country made liquor. The petitioner is languishing in custody since 21.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the meager quantity of illicit liquor and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Phulwari Sharif P.S. Case No. 1010 of 2022.
