This is an application for grant of anticipatory bail in connection with Complaint Case No. 269(C) of 2019 registered for the offence punishable under Sections 406, 420, 467, 468, 471/34 of the Indian Penal Code and Sections 323, 504, 506 of the Indian Penal Code has been added.

The allegation is regarding the complainant having come in contact with the accused persons including the petitioner and is said to have negotiated for purchase of land for which some money was also given, however, sale deed was not executed in favour of the complainant and the money was misappropriated.

No.75657 of 2019(3) dt.20-12-2019 2/2 The learned counsel for the petitioner submits that the petitioner is innocent, he is having a clean antecedent and on account of the fact that he had filed a case earlier against the complainant of the present case, the present case has been filed falsely with vengeance.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Complaint Case No. 269(C) of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
