====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-01-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehend arrest in a case registered for the offences punishable under Section 366A of Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
3. It is alleged that this petitioner along with other F.I.R. named accused persons kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioner submits that victim in her statement, recorded before the Police has not supported the prosecution case and stated that she was talking with the petitioner since three years on mobile phone which was gifted to her by the petitioner. Victim was in courtship with the

No.80162 of 2023(2) dt.10-01-2024 2/2 petitioner and he called her to Bettiah to solemnize marriage due to which she fled away to Bettiah and he took her to his house, kept her there for three days and after that he took her to her Fua's house. Petitioner claims clean antecedent.
5. In view of the statement of the victim before the police, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge- 6th cum Special Judge POCSO at Bettiah, West Champaran in connection with Bettiah Muffasil P. S. Case No. 1007 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
