The petitioner apprehends his arrest in Khagaria (Muffasil) P.S. case No. 356 of 2019 registered under Section 366A/34 of the IPC.

The informant alleged that her minor daughter became traceless from her house while she had gone to attend the marriage of daughter of her neighbour, Vijay Sah. The informant further alleged that Pawan Mahto, Gautam Kumar and Bipin Kumar came to her house in inebriated condition and abused the informant and her daughter. They also threatened to kidnap her daughter.

The learned counsel for the petitioner submits that the entire allegation is false and concocted. The victim is a major girl and she disclosed her age to be 19 years. She further

Patna High Court CR. MISC. No.65827 of 2019(2) dt.21-10-2019 2/2 disclosed that she was having love affairs with the petitioner, Bipin Kumar, and she called him and went along with Bipin Kumar to Chennai.

It appears that the victim herself denied the factum of her kidnapping and she disclosed that she voluntarily left her house and went along with Bipin Kumar and solemnized marriage.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. case No. 356 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
