2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 467, 468 , 471 and 120(B) of the Indian Penal Code .
3. As per the prosecution case, petitioner is alleged to have procured appointment on the post of Panchayat Teacher on the basis of forged and fabricated certificates.
4. It is submitted that petitioner is innocent and has been falsely implicated in this case. At the time of appointment, petitioner furnished all the relevant documents and after verification of those documents by the competent authority, petitioner was appointed as Panchayat Teacher. Petitioner has committed no offence . It is lastly submitted that petitioner has
Patna High Court CR. MISC. No.73364 of 2023(6) dt.02-07-2024 2/2 already been terminated from service vide letter no. 60 dated 08.07.2023, issued by the Panchayat Secretary-cum-Member Secretary, Jhajha, Jamui. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the fact that already been terminated from the aforesaid post and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Jhajha P.S. case No. 186 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
