2. The petitioner seeks regular bail in a case registered for the offence under Sections 376(2), 376(3) of the Indian Penal Code and Section 4/6 of the POCSO Act.

3. As per the prosecution case, the petitioner is said to have committed rape upon a minor victim.

4. Learned counsel for the petitioner submits that in trial the victim has not supported the prosecution case and the petitioner is in custody since 10.07.2023. Petitioner claims clean antecedent.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the

Patna High Court CR. MISC. No.74060 of 2023(3) dt.27-02-2024 2/2 case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-VI-cum-sPECIAL Judge, POCSO Act, Buxar/concerned Court below in connection with navanagar(Basudeva) P.S. Case No. 264 of 2023 subject to condition that:- 7(i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
