JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2020 The present application has been filed for modification of order dated 14.09.2016 passed in Cr. Misc. No. 39670 of 2016 to the extent of confirming the provisional bail granted to the petitioner in connection with Complaint Case No. C 264 of 2013, wherein process was directed to be issued after cognizance being taken for the offence punishable under Section 498A of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, Ist Class, Raxaul.

The petitioner, being the mother of the late husband of the complainant, has been granted provisional bail for four months on the ground that she is ready to give share to the complainant and statement to that effect was made paragraph 10

Patna High Court CR. MISC. No.60377 of 2017(15) dt.04-03-2020 2/2 of the main petition, which reads as follows:- "That, the petitioner is not ready to keep complainant with her, but she is ready to give share in the favour of his grand-son."

The matter was adjourned for several occasions but no affidavit was filed on behalf of the petitioner with regard to the share of the complainant. In the meantime, the bail bond of the petitioner has been cancelled vide order dated 06.09.2017 passed in Trial No. 37/17, arising out of Complaint Case No. 264 of 2013by learned Judicial Magistrate, Raxaual. It is submitted by learned counsel for the petitioner that at present he has no instruction in the matter. In the circumstances, this Court is not inclined to interfere. Accordingly, this application is disposed of as not pressed.
