The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 188, 323, 353, 283 and 504 of the Indian
Patna High Court Cr.Misc. No.61884 of 2017 (2) dt.21-12-2017 2/3 Penal Code.
The prosecution case initiated on the self statement of Raj Kumar, SHO, Pipra Police Station, is to the effect that on 18.08.2017 the informant along with Block Development Officer and Circle Officer, Chakia was inspecting the flood affected areas, in the meantime, he received telephonic information that on 17.08.2017 in the evening one Dipan Ram died in a road accident, concerning which the local people have blocked NH-28 in protest. When the police reached at the spot, the mob manhandled the police force, leading to registration of the FIR against 22 named and 150-200 unknown. It is submitted by learned counsel for the petitioners that the accusation has been levelled against the mob. The police lodged the case since the people were protesting against inaction of the police in a road accident. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.
Learned APP, however, submits that there is accusation against the petitioners that they obstructed the administration including the police in discharging their official duty.
Considering the accusation against the mob
Patna High Court Cr.Misc. No.61884 of 2017 (2) dt.21-12-2017 3/3 coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Pipra P.S. Case No. 199 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
