It transpires to this Court upon perusal of the pleadings in the writ petition that the present writ petition has been filed to set aside the order dated 08.02.2019 contained in Letter No.251 passed by the District Programme Officer, Gaya challenging the post of Anganbari Sevika at Anganbari Center No.213 Bishnupur, Ward No.07, Panchayat Nepa at BlockTekari, District- Gaya.

3. Learned counsel for the State raised preliminary

Patna High Court CWJC No.20916 of 2019(3) dt.30-07-2024 2/2 objection and submits that guidelines have been issued from time to time for the purpose of appointment of Anganbari Sevika and Sahayika and according to the relevant guidelines, the order passed by the DPO, Gaya has to be challenged before the appellate forum.

4. In this background, the present writ petition stands disposed off granting liberty to the petitioner to avail her remedy before the appellate forum as mentioned in the relevant guidelines for the appointment of Anganbari Sevika and Sahayika within 30 days from the date of passing of the order.

5. It is made clear that if, the petitioner prefers appeal within the said period, the Appellate Authority is hereby directed to condone the delay if any in filing the appeal. (Dr. Anshuman, J) Divyansh/- U
