JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 395/397 of the Indian Penal Code and 3⁄4 of the Explosive Act.

Learned counsel for the petitioner submits that the petitioner is in judicial custody since 09.06.2019. Vide order dated 29.01.2020 a report was called for from the learned court below regarding the stage of trial. I perused the enclosed report, in which the Additional District and Sessions Judge-17, East Champaran, Motihari has reported that this case is fixed for the hearing on the point of charge. The next date of the case is 15.02.2020.

Patna High Court CR. MISC. No.70673 of 2019(11) dt.20-07-2021 2/2 Considering the various criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Chhauradno P.S. Case No. 155/2019 from the Court of learned Sub Divisional Judicial Magistrate, Raxaul, Motihari.

Accordingly, this application is dismissed.

However, the learned court below is directed to expedite the trial and conclude the same within a period of one year.
