The petitioner is in custody in connection with Mahua P.S.Case No.172 of 2017 registered for an offence under Section 414 of the IPC and Sections 25(1-b)a/26 and 35 of the Arms Act. The informant of this case is the police officer who apprehended three persons when they were moving on a motorcycle.

It is said that from the possession of this petitioner one country made fire arm and some live cartridges were recovered. The petitioner has been denied the allegation of recovery of any fire arm and claims false implication after plantation of fire arms. The petitioner is in custody since 04.07.2017 having clean

Patna High Court Cr.Misc. No.60726 of 2017 (2) dt.20-12-2017 2/2 antecedent except one case bearing Hajipur Nagar P.S.Case No.450 of 2017 which was registered subsequent to the present case.

The learned APP opposed the submissions.

Considering the nature of the allegation facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in connection with Mahua P.S.Case No.172 of 2017 with condition that one of the bailors of the close family members of the petitioner.
