2. The petitioner seeks bail in connection with Gidha P.S. Case No. 52 of 2024 registered for the offence under Sections 365 of the Indian Penal Code.

3. As per the prosecution case, the nephew of the informant disappeared on 13.06.2024 and subsequently, his dead body was found.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has not participated in the killing of the deceased.

5. It has further been submitted by the learned counsel for the petitioner that the petitioner petitioner has no criminal history and he is in jail since 13.7.2024.

6. Learned APP for the State has submitted that the petitioner is involved in the disposal of the dead body.

7. Considering the aforesaid facts, this application

Patna High Court CR. MISC. No.71828 of 2024(2) dt.03-10-2024 2/2 is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara/concerned Court below in connection with Gidha P.S. Case No. 52 of 2024.

9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the criminal antecedent of the petitioner. If the Court below finds that the petitioner has no criminal antecedent, his bail bonds shall be accepted. If the Court below finds that the petitioner is involved in any other case, his bail bonds shall not be accepted.

10. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Gidha Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
