2. The petitioner seeks bail, who is in custody since 19.03.2022, in connection with N.D.P.S P.S. Case No. 49 of 2022 arising out of N.C.B. Case No. 09 of 2022, FIR dated 23.03.2022 registered for the offence under Sections 8(c), 21(b), 25 and 29 of the N.D.P.S Act.
3. Earlier the bail application of the petitioner was rejected vide order dated 10.05.2023. Thereafter the petitioner moved before the Hon'ble Apex Court in S.C.A No. 9024 of 2023 but the same was dismissed on 03.11.2023. Thereafter, the
Patna High Court CR. MISC. No.71415 of 2025(3) dt.07-11-2025 2/3 petitioner again moved before this Court vide Cr. Misc. No. 87071 of 2024 which was also dismissed on 17.01.2025.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. He further submits that that the trial is not concluded yet and the petitioner is in custody since 19.03.2022.
5. Vide order dated 09.10.2025 a report was called with regard to stage of the trial. Report of the learned Trial Court dated 17.10.2025 reveals that the case is pending at the stags of evidence and out of six charge-sheet witnesses, only four witnesses have been examined and two witnesses are yet to be examined.

Learned counsel for the UOI vehemently opposed the prayer for bail of the petitioner and submits that it appears from the CDR location of the petitioner that he had frequent conversation with accused Upendra Ram and through the CDR analysis it has been found that the petitioner was the supplier and apart from that petitioner carries four criminal antecedents and out of four cases two cases pertain to NDPS matter.

Considering the aforesaid facts that the Regular Bail application of the petitioner was rejected by the Hon'ble Apex Court, report of the trial Court and the fact that the recovered contraband is more than the commercial quantity and the petitioner is an accused in four cases, out of four cases two cases are pertaining to NDPS matter, I am not inclined to enlarge the petitioner on bail in connection with N.D.P.S P.S. Case No. 49 of 2022 arising out of N.C.B. Case No. 09 of 2022 pending in the court of learned Additional Sessions Judge-IIIrd, Bhojpur at Ara.
8. Prayer is refused.
9. However the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Suruchi/- U T
