JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Bheldi P.S. Case No. 176 of 2019, disclosing offences under Section 392 of the Indian Penal Code.

Prosecution case is that while the informant was returning to his house from motorcycle, three persons came on motorcycle and intercepted him and on the point of pistol snatched away his golden chain, mobile and cash of Rs. 25,000 and other documents.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case as earlier his father has lodged a case against the brother in law of the informant and due to which, the present case has been lodged and though, he is named in the F.I.R. nothing has been recovered from him.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XII, Chapra, District - Saran, in connection with Bheldi P.S. Case No. 176 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
