2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 120 of the Indian Penal Code and Section 26, 35, 25 (1-b) a of the Arms Act.

3. The case of the prosecution is that altogether nine live cartridges and three empty cartridges were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case. It is further submitted by the learned counsel for the petitioner that while making the seizure, section 100 of the

Patna High Court CR. MISC. No.72573 of 2024(2) dt.08-10-2024 2/2 Cr.Pc. was not complied. Petitioner is having no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 18.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with S.Kamal P.S. Case No. 171 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
