2. The petitioner seeks regular bail in a case registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, One Md. Khurshid is said to have fired upon the deceased. This petitioner along with others is said to have caught hold the deceased.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2023, he is quite innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Story of catching hold by 11 persons does not seem to be believable.

7. In view of above, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.-II, Munger/concerned Court below in connection with Muffasil P.S.
