2. The petitioner seeks bail in connection with POCSO Case No. 78 of 2023 arising out of Ara Nawada P.S. Case No. 114 of 2023 registered for the offence punishable under Sections 365 and 366 (A)/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is an accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The victim was in a relationship with the petitioner and has solemnized marriage in a temple at Ara. The victim in her

Patna High Court CR. MISC. No.72810 of 2023(2) dt.09-11-2023 2/2 statement made under Section 164 Cr. P.C. has said that she has got married to the petitioner. The petitioner is in jail since 29.04.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara/ concerned Court in connection with POCSO Case No. 78 of 2023 arising out of Ara Nawada P.S. Case No. 114 of 2023.
