2. The petitioner seeks regular bail in connection with Rivilganj P.S. Case No.236 of 2020 registered for the offences punishable under Sections 363, 365, 366A & 376 of the Indian Penal Code and Sections 4 & 6 of the POCSO Act.
3. As per the prosecution case, on 08.07.2020 at about 10:00 A.M., the daughter of the informant went outside of the house for nature call and since then she did not return back.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the victim girl has not made any
Patna High Court CR. MISC. No.72529 of 2024(3) dt.16-12-2024 2/2 allegation against the petitioner. The victim had love affairs with the petitioner and now the marriage has been solemnized between them and are living together having a child. The petitioner is in jail custody since 16.08.2024. He further submits that the petitioner has no criminal antecedent and he undertakes to co-operate in the trial.
5. Learned counsel for the informant submits that both the parties have compromised and the victim is happily residing with the petitioner after solemnization of their marriage. Learned APP for the State has also conceded the said fact.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Chapra / Concerned Court in connection with Rivilganj P.S. Case No.236 of 2020.
