1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Jakkanpur P.S. Case no. 509 of 2022 registered under sections 8(c), 21(c), 25 and 29 of the N.D.P.S. Act.

3. As per the prosecution case, 6 grams of smack is said to have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 3.5.2024 passed in Cr. Misc. no. 22669 of 2024 giving liberty to the petitioner to renew his prayer for bail on completing two years in custody. The petitioner has remained in

Patna High Court CR. MISC. No.73308 of 2024(2) dt.29-10-2024 2/2 custody for more than 2 years since 23.9.2022 and charge has been framed in the case. The petitioner undertakes to cooperate in the trial.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R, the petitioner having remained in custody for more than 2 years since 23.9.2022, the liberty granted in the earlier order of rejection dated 3.5.2024 and charge having been framed in the learned trial Court, the petitioner is directed to be enlarged on bail in connection with Jakkanpur P.S. Case no. 509 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IVcum-Special Judge, NDPS Act, Patna.
