Petitioner, already in custody, seeks bail in connection with Rail Arrah P.S. Case No.71 of 2017 registered under Sections 304/34 of the Indian Penal Code.

Allegation in brief is that while the informant along with the deceased was going by a train and standing by the gate of the boggy, they were hit by a piece of danda by some unknown four persons from the outside as a result both fell down from the train and one of the persons succumbed to the injury.

Learned counsel for the petitioner submits that the FIR is against unknown, there is no evidence that the petitioner was involved in the occurrence except his confessional

Patna High Court Cr.Misc. No.44062 of 2018(2) dt.20-07-2018 2/2 statement given to the police, the petitioner has been in custody since 27.03.2018 and has no criminal antecedent and the petitioner was also not put on TIP.

Having considered the aforesaid facts and circumstances, petitioner Golu sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Bhojpur at Arrah in connection with Arrah P.S.
