JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Earlier prayer for bail of the petitioner was rejected twice by this Court vide order dated 27.4.2017 passed in Cr.Misc.No. 11415 of 2017 and vide order dated 15.11.2017 passed in Cr.Misc.No. 53682 of 2017. Petitioner is main accused in a case of murder.

Submission of learned counsel for the petitioner is that as yet only four witnesses have been examined and petitioner is in custody since 21.5.2016 and all the witnesses have been declared hostile.

Heard learned APP also.

Having heard both sides and in view of nature of allegation, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the

Patna High Court Cr.Misc. No.44063 of 2018 (2) dt.01-08-2018 2/2 trial and try to conclude it as soon as possible, without giving unnecessary adjournment. At the same time, Sr.S.P., Bhagalour is directed to ensure the presence of the witnesses in court on the date fixed, so that trial may be concluded at the earliest.
