Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Bhore PS case no. 151 of 2024, disclosing offences punishable under Section 307 and other allied sections of the Indian Penal Code. 3.

The prosecution story, as per the First Information Report, is that on 08.06.2024 in the evening, while the informant was having bath, the petitioner along with other accused persons came there and co-accused Vijay Bhagat caught hold the informant and petitioner inflicted knife blow upon the informant on his head and other accused persons assaulted him with bricks and lathi. 4.

Learned Counsel for the petitioner submits that petitioner is own nephew of the informant and co-accused Vijay Bhagat is the full brother of the informant. It is apparent that there was admitted land dispute between the parties. Learned counsel

Patna High Court CR. MISC. No.71985 of 2024(2) dt.28-10-2024 2/2 further submits that injuries caused to the informant are not serious in nature, as would be evident from Annexure-2 i.e. injury report. 5.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are closely related, there is previous land dispute between them and injuries caused to the victim are not serious in nature, I am inclined to grant the privilege of anticipatory bail to the petitioner. 6.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Bhore PS case no. 151 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
