Petitioner, already in custody, seeks bail in connection with Raghunathpur P.S. Case No.210 of 2017, registered under Sections 413, 414, 420, 467, 468, 471 read with Section 34 of the Indian Penal Code.
Allegation in brief is that the petitioner along with others were found standing by the side of a motorcycle in front of the bank and they were apprehended, one Master Key and Rs.24,500/- were also recovered from his possession. Learned counsel for the petitioner submits that the so called recovery of motorcycle was not made from the conscious possession of the petitioner rather he was only standing by the side of the motorcycle and for the same offence, another case
Patna High Court Cr.Misc. No.45587 of 2018(2) dt.30-07-2018 2/2 was earlier instituted, the petitioner is the resident of Uttar Pradesh and had one antecedent under Section 302 I.P.C. but in that case he is on bail and investigation of the case has already been completed.
Having considered the aforesaid facts and circumstances, petitioner Ajit Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Siwan in connection with Raghunathpur P.S.
