Petitioner, already in custody, seeks bail in connection with Aurangabad (T) P.S. Case No.240 of 2017, registered under Sections 399 and 402/414 of the Indian Penal Code as well as under Sections 25(1-b)a/26/35 of the Arms Act. Accusation is that on secret information regarding assembly of criminals making plan for committing dacoity, police reached at the spot and apprehended some of the miscreants and others escaped away and the persons apprehended disclosed the name of the petitioner as one of the persons who escaped away.

Learned counsel for the petitioner submits that except

Patna High Court Cr.Misc. No.47325 of 2018(2) dt.02-08-2018 2/2 disclosure of the name made by the other accused apprehended at the spot, there is no other material against the petitioner. However, the petitioner has been remained in custody for more than eight months.

Having considered the aforesaid facts and circumstances, petitioner Pukar Mehta @ Raj Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Aurangabad in connection with Aurangabad (T) P.S. Case No.240 of 2017, giving rise to Sessions Trial No.19 of 2018/121 of 2018. (Arun Kumar, J) S.KUMAR/- U T
