JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pakridayal P.S. Case No. 160 of 2019 registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act.

Allegation is of recovery of liquor from the shop of co-accused persons, who have disclosed the name of the petitioner and stated that they brought the liquor on behalf of petitioner for sale.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and he has falsely been implicated in this case, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for

No.62750 of 2019(2) dt.15-10-2019 2/2 anticipatory bail of the petitioner stating that from the impugned order it appears that in paragraph-7 of the case diary 20 witnesses have supported the prosecution case. In view of above facts and circumstances, this application is disposed of with direction to the court below to verify the materials against the petitioner and if any independent witness has disclosed the name of the petitioner, petitioner has to surrender and pray for regular bail, otherwise the court below shall release the petitioner on bail to its own satisfaction.
