2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 709.200 litres of Indian made foreign liquor from the truck bearing Reg. No. HR-61E-9921 and petitioner was apprehended as he was driving the said truck.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely because he was the driver of the truck in question. Petitioner had no knowledge with respect to the seized liquor kept in the truck. Petitioner is not the owner of the said truck. The charge-sheet has already been submitted after completion of

Patna High Court CR. MISC. No.69686 of 2025(3) dt.15-10-2025 2/2 investigation and there is no chance of tampering with the evidence by the petitioner or absconding of the petitioner. Petitioner has clean antecedent and he is in custody since 02.07.2025 and he undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court-II, Jamui/concerned court below in connection with Prohibition P.S.
