The petitioner apprehends her arrest in connection with Barbigha (Kewati) P.S. Case No.47 of 2017/G.R. No.143 of 2017 registered under Sections 420, 406, 409, 467, 468, 471 and 120B of the Indian Penal Code.
The accusation is that Madhurima Singh alias Madhuri Singh, the Child Development Project Officer, Barbigha, Sheikhpura, Shweta Kashyap, being the Ladies Supervisor and this petitioner being the Ladies Sewika misappropriated the fund allotted for disbursement amongst the pregnant lady, malnourished children and others.
Learned counsel for the petitioner submits that initially
Patna High Court Cr.Misc. No.60854 of 2017 (2) dt.14-12-2017 2/2 the matter was enquired by the authority and the allegation was found untrue. However, liberty was given to the informant to lodge criminal case. Thereafter, the informant, who is Sarpanch of the Panchayat, has lodged this case. Further submission is that Madhurima Singh alias Madhuri Singh, the Child Development Project Officer, Barbigha, Sheikhpura, has already been granted the privilege of pre-arrest bail by a Bench of this Court vide order dated 28.06.2017 passed in Criminal Misc. No.17504 of 2017. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Sheikhpura, in connection with Barbigha (Kewati) P.S. Case No.47 of 2017/G.R. No.143 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
