Mr. Murli Dhar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Naubatpur P.S. Case No. 235 of 2018, registered for the offence punishable under Sections 399, 402, 307, 353 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 and 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that the name of the petitioner was disclosed by the co-accused Abhishek and nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 06.03.2019.

Patna High Court CR. MISC. No.63048 of 2019(2) dt.24-10-2019 2/2 Learned A.P.P. appearing for the State submits that petitioner is named accused in the first information report and petitioner does not possesses clean antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.

Accordingly, this application is rejected with liberty to the petitioner that he may renew his prayer for bail after framing of charge.
