The petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Prosecution case as lodged by the informant is that on 01.12.2018 in the evening his red colour Mahendra tractor bearing its registration no. BR24DA-8348 was robbed by three unknown criminals after giving gun shot injury to his driver. The allegation against the petitioner is that he was found in the possession of the aforesaid robbed tractor which was parked in front of the house of the petitioner.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. no TI Parade has been done yet and petitioner is in custody since 03.08.2019. He submits

No.66991 of 2019(3) dt.04-12-2019 2/2 that petitioner is bonafide purchaser of the tractor which he had purchased from his nephew Vijay Uraon on consideration amount of Rs. 2,50,000/- in which he had already paid 1,50,000 to Vijay Uraon. The learned counsel for the petitioner has further submits that Vijay Uraon has also executed sale papers in favour of the petitioner. He further submits that petitioner bears no criminal antecedent as stated in para-3 of the bail petition.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Kargahar Police Station Case No. 454 of 2018.
