2. This is 4th attempt for grant of bail on behalf of petitioner. Lastly, the prayer for bail of petitioner was rejected, vide order dated 29.03.2023 passed in Cr.Misc. No. 69220 of 2022 with an observation to conclude the trial as early as possible preferably within a period of one year.

3. The trial Court report reveals that till date only three prosecution witnesses have been examined and prosecution has been directed to produce rest witnesses.

4. Learned counsel for the petitioner submits that despite direction of this Court, trial has not been concluded and petitioner is in custody since 16.07.2020 i.e. approximately five years.

5. Considering the tardy progress of trial and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (N.D.P.S. Act), Court No. 1, Patna in connection with Special Case No. 85 of 2020, arising out of Khusrupur P.S. Case No. 185 of 2020.
